Terms of Use - Eminvite

These Terms of Use (the "Terms") govern the use of the Eminvite web service (the "Service"), which provides the ability to create personalized invitations for weddings, holidays, and other events, as well as send such invitations via email and messengers.

By registering with the Service or using it in any other way, the User confirms that they have carefully read, understood, and accept these Terms.

1. Terms and Definitions

In these Terms:

Service –the Eminvite online platform that allows creating and sending digital invitations.
User –an individual or legal entity that registers with the Service or uses it without registration.
Account –a collection of User data in the Service, protected by login and password.
Invitation –a digital product created by the User with text, images, and other elements.
User Content –any materials that the User uploads or creates in the Service.

2. Registration and Access to the Service

2.1.To use the full functionality of the Service, the User must create an account by providing accurate and current information.
2.2.The User is fully responsible for maintaining the confidentiality of their login credentials and for all actions that occur under their account.
2.3.In case of suspected unauthorized access to the account, the User must immediately change the password and notify the Service administration.

3. Service Description

3.1. The Service provides Users with the ability to:

•create personalized invitations for weddings, holidays, and other events;
•save and edit created invitations;
•distribute invitations by sending them via email or messengers;
•use other features described on the Service website.

3.2.The Service functionality may be changed, supplemented, or limited unilaterally by the administration without mandatory prior notice to Users.

4. Paid Services and Payment

4.1.Some Service features may be paid (e.g., access to certain templates, styles, additional functionality).
4.2.Current rates, payment terms, and descriptions of paid features are posted on the Service website.
4.3.Payment is made through third-party payment services. The Service is not responsible for their operation.

5. Refund Policy

5.1.Refunds for paid invitations are only possible if the following conditions are met simultaneously:

•the invitation has not been published (not sent to any recipient, no public link generated);
•at least 7 calendar days remain until the event date.

5.2.An invitation is considered published from the moment of first sending or link distribution.

5.3.In all other cases, no refunds are provided.

6. Acceptable Use of the Service

6.1.The User undertakes not to post or distribute prohibited content through the Service:

✗pornographic materials;
✗hate speech, discrimination, calls for violence;
✗content that violates copyrights;
✗spam, intrusive advertising;
✗fraudulent or manipulative materials.

6.2.It is prohibited to use the Service for illegal activities, spam, unauthorized access, or distribution of malicious software.

6.3.Commercial use of the Service without prior administration consent is prohibited.

7. User Content and Intellectual Property Rights

7.1.All User Content remains the property of the User or the respective rights holders.
7.2.By posting Content, the User grants the Service a non-exclusive license to use such Content within the scope of the Service's operation.
7.3.The User warrants that they have all necessary rights to use and distribute the Content.
7.4.Upon receiving complaints, the Service has the right to restrict access to or delete the Content.

8. Account Suspension and Deletion

8.1.The Service has the right to suspend access to or delete a User account in case of violation of these Terms, posting prohibited content, or attempts of unauthorized access.
8.2.Suspension or deletion may be carried out without prior notice and without reimbursement of any costs or losses.
8.3.In case of suspension or deletion due to violation of the Terms, payments for paid services are non-refundable.

9. Liability of the Parties

9.1. The User is fully responsible for:

•the accuracy and completeness of the information they provide;
•the Content they create, upload, and distribute via the Service;
•compliance with the rights and legitimate interests of third parties.

9.2. The Service is not liable for:

•the content of Invitations and the consequences of their distribution;
•technical failures or interruptions in the operation of third-party services;
•loss of access to the Service caused by the User's actions or negligence.

9.3.The Service is provided on an "as is" basis. The administration does not guarantee uninterrupted or error-free operation of the Service.

10. Privacy and Data Protection

10.1.The processing of personal data is carried out in accordance with the Service's Privacy Policy.
10.2.By registering or using the Service, the User consents to the processing of their personal data.

11. Amendments to the Terms

11.1.The Service has the right to amend these Terms. The updated version becomes effective from the moment of its publication on the Service website.
11.2.Continued use of the Service after the Terms have been amended constitutes the User's acceptance of the updated version.

12. Governing Law and Dispute Resolution

12.1.These Terms are governed by the substantive law of Ukraine.
12.2.Disputes shall be resolved through negotiations, and if no agreement is reached, they shall be submitted to the courts at the location of the Service administration.
